1. Introduction

Welcome to HomesKitsPro. These Terms and Conditions (“Terms”) govern your use of our website at www.homeskitspro.com and the purchase of products from our online store. By accessing or using our website and placing an order, you agree to be bound by these Terms.

HomesKitsPro is a brand owned and operated by Homefix Kits Pro, a business registered in Kenya. We are an online retail store selling household appliances, electronics, water and plumbing products, tools, hardware, and home improvement goods. For customer convenience, order collections and authorized returns can be dropped off at our physical package hub located at Mbogo House, Ground Floor, Stall B3, Moi Avenue, Nairobi CBD. Please read these Terms carefully before making a purchase. If you do not agree with any part of these Terms, you should not use our website or place an order.

2. Eligibility

By placing an order on our website, you confirm that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian.
  • You are legally capable of entering into a binding contract under Kenyan law.
  • The information you provide during registration and checkout is accurate, current, and complete.
  • You are purchasing products for personal, household, or legitimate business use and not for resale without our prior written consent.

3. Products and Availability

3.1 Product Descriptions

We make every effort to ensure that product descriptions, images, specifications, and prices on our website are accurate and up to date. However, we do not warrant that product descriptions or other content are error-free, complete, or current. In the event that a product is described inaccurately, your sole remedy is to return the product in an unused condition in accordance with our Returns Policy.

3.2 Stock Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion. If a product you have ordered is out of stock after payment, we will contact you within 2 business days to offer an alternative, a substitution, or a full refund.

3.3 Pricing

All prices are displayed in Kenya Shillings (KES) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you complete your purchase. Shipping charges are calculated separately at checkout based on your delivery location and product dimensions.

4. Orders and Contract Formation

When you place an order on our website, you are making an offer to purchase the selected products. An order confirmation email sent to your registered email address acknowledges receipt of your order but does not constitute acceptance. A binding contract is formed only when we dispatch your order and send you a shipping notification.

We reserve the right to decline or cancel any order for reasons including but not limited to:

  • Payment failure or suspected fraudulent transactions.
  • Errors in pricing or product information on our website.
  • Products being unavailable or discontinued.
  • Delivery restrictions to your location.

If we cancel your order after payment has been received, we will issue a full refund within 5 to 7 business days using the same payment method used for the original transaction.

5. Payment

We accept the following payment methods:

  • M-Pesa via Paybill or Till Number
  • Visa and Mastercard debit/credit cards
  • Pesalink
  • Direct bank transfer

All card, Pesalink, and M-Pesa transactions are processed securely through Paystack, a PCI-DSS compliant payment gateway. Customers may also pay directly via M-Pesa Paybill at checkout. HomesKitsPro does not store your card details on our servers.

Payment is required in full at the time of placing your order. We do not offer credit terms or payment on delivery unless specifically advertised as a promotion. By submitting payment details, you confirm that you are authorised to use the payment method provided.

6. Delivery

6.1 Delivery Coverage

We deliver nationwide to all major counties, towns, and regions across Kenya. Delivery is made to a convenient regional courier pickup point or directly to your physical address depending on your selected location transit routes.

6.2 Delivery Timelines

Orders are subject to a 1-business-day processing time. Estimated transit times across our delivery zones are as follows:

  • Zone 1 (Nairobi & Environs): 1 to 2 business days transit time.
  • Zone 2 (Major Towns & County Hubs): 2 to 3 business days transit time.
  • Zone 3 (Other Towns & Remote Regions): 3 to 5 business days transit time.

These timelines are close estimates. Delays may occasionally occur due to public holidays, adverse weather conditions, or courier partner infrastructure disruptions. HomesKitsPro will work diligently to update customers but cannot be held liable for third-party shipping delays beyond our direct control.

6.3 Shipping Charges

Shipping costs are calculated flatly at checkout based on your delivery zone classification and order weight categories. Standard local flat shipping rates start at KSh 400, KSh 600, or KSh 900 respectively. Your final exact delivery cost will be clearly displayed before payment processing.

6.4 Risk and Ownership

Risk of loss or damage to products passes to you upon delivery. Ownership of products passes to you upon receipt of full payment.

6.5 Failed Delivery

If a delivery attempt fails because no one is available to receive the order, our logistics courier will make contact using the phone number provided at checkout. If we are unable to reach you or complete delivery after reasonable attempts, the order may be returned to our hub and re-delivery charges may apply.

7. Returns and Refunds

7.1 Return Period

You may return an eligible product within 7 days of delivery. To initiate a return, you must contact our support channels within this 7-day window.

7.2 Eligible Returns & Restocking Fees

We will gladly accept returns and issue a full refund or direct item replacement if the product is defective, damaged upon arrival, or the incorrect item was delivered.

For change-of-mind returns or customer-selected sizing errors, items must be completely unused, uninstalled, in their original unmodified packaging, and in the exact condition received. Please Note: All change-of-mind or customer-error returns are subject to a mandatory 20% restocking fee to cover administrative and processing overheads.

7.3 Non-Returnable Items

The following items cannot be returned under any circumstance unless they possess a core manufacturing defect:

  • Items that have been used, mounted, installed, or structurally damaged by the customer.
  • Items missing their original retail box, packaging elements, or accessories.
  • Perishable, customized, or specially tailored product orders.

7.4 Refunds

Approved refunds will be processed within 7 to 14 business days after our warehouse team receives, inspects, and validates the returned item. Refunds are issued directly back to the original payment method used. Initial shipping costs are strictly non-refundable unless the return stems entirely from our administrative error or a proven manufacturing defect.

8. Intellectual Property

All content on our website, including text, images, logos, product descriptions, graphics, and design elements, is the property of HomesKitsPro or its content suppliers and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from our website without our prior written permission.

9. User Accounts

To place an order, you may be required to create an account on our website. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that are found to be used fraudulently, in violation of these Terms, or in a manner that may harm other users or our business.

10. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy, which is available on our website. By using our website and placing an order, you consent to our collection and use of your data as described in that policy.

We are committed to protecting your personal data and comply with applicable data protection regulations in Kenya, including obligations under the Data Protection Act, 2019.

11. Limitation of Liability

To the maximum extent permitted by applicable law, HomesKitsPro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or from the purchase of our products, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you for any claim arising from a transaction on our website shall not exceed the amount you paid for the specific product or order that gave rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Kenyan law.

12. Consumer Rights (Kenya)

These Terms do not affect your statutory rights as a consumer under Kenyan law, including those provided by the Consumer Protection Act, 2012. You are entitled to products that are of satisfactory quality, fit for purpose, and as described. Where a product fails to meet these standards, you have the right to a repair, replacement, or refund as appropriate.

13. Prohibited Use

You agree not to use our website or services to:

  • Engage in any unlawful activity or violate any applicable law or regulation.
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorised access to our systems or data.
  • Use automated tools to scrape, crawl, or extract data from our website without permission.
  • Harass, abuse, or harm other users or our staff.

Our website may contain links to third-party websites or services such as payment processors and courier partners. These links are provided for your convenience only.
